 Advantest to Continue Patent Battle with TechWing

TOKYO, Japan, February 1, 2007 - Advantest Corporation (TSE: 6857, NYSE:ATE), filed an action for an injunction and compensation for damages against TechWing, Inc. (CEO: Jae-Gyun Shim, headquarters: Hwaseong City, Republic of Korea; hereinafter "TechWing") on grounds that TechWing's two memory test handler models (TW282 and TW292) infringe Korean patents (Patent Nos. 292831, 312093 and 355422) owned by Advantest. TechWing also filed an action for a confirmation that the above Korean patents were invalid (hereinafter "confirmation of invalidity") and that TechWing's products were held not to fall within the scope of above Korean patents. The injunction case is still pending before the court in Korea.
Regarding the confirmation of invalidity, the Patent Court of Korea ruled on February 1st, 2007 that Advantest's Korean patent (No. 312,093) was invalid.
Today's ruling is not final and conclusive, and may be overturned by a higher court. Advantest has not yet received written confirmation of the ruling. On reception of this written confirmation, Advantest will make a decision on how to proceed with both this ruling and the ruling of January 18th, 2007.
Advantest has also filed a suit against TechWing in Taiwan, seeking a suspension of imports to that country of the TechWing test handlers that allegedly infringe Advantest patents. It is hoped that the Taiwanese court will grant Advantest an injunction that would prevent these handlers from being imported and / or sold. Further, should it be revealed that TechWing appears to have infringed any other of Advantest's patents, Advantest will consider filing a new lawsuit against TechWing.
